3 Simple Ways to Protect Your Blog (and your money)

Imagine you have spent YEARS toiling away and constructing the perfect blog, showcasing your incredible works, and featuring your most impressive products to your niche market.

You have put endless amounts of effort into this blog. This blog is your life.

Now, stop for a second and picture this: a lawsuit has been filed against you, claiming you have put forth false information, or that you have not provided proper legal documentation to even present your blog to the world. Or, some other massive problem, causing your heart to beat quickly and fervently. (How could this happen?!)

Wow.

Most people don’t want to tell you about the more cumbersome side of blogging: the fact that you do indeed have to provide legal documents, available on your website, in order to be a fully covered, and functioning blog.

Being a digital content producer for 10-plus years, I’m here to tell you about STEP ONE of getting your blog set up: feature the following pages on your website. I will outline them below.

1.       TERMS AND CONDITIONS

The Terms and Conditions are also known as the “Terms of Use” or the “Terms of Service.”

What does that mean?

It means these are your website’s RULES. These are important because they explain, for one, what is allowed on your website, and what is not permitted.

Also, they form a legal binding contract between you and your website user (incorporating your Privacy Policy and your Disclaimer, which I will discuss later) and they can be used later in court to enforce your rights and settle any legal disputes that may arise.

Many bloggers choose to include the following in their Terms and Conditions page:

INTELLECTUAL PROPERTY RIGHTS

LAWFUL USE OF YOUR WEBSITE

RESERVATION OF YOUR RIGHTS

REFUND OR EXCHANGE POLICIES

GOVERNING LAW PROVISIONS

I highly suggest including a rather extensive Terms of Conditions page on your website.

Working in the digital content industry over the years, I have seen people who have regretted not implementing this page on their site, simply due to their lack of knowledge on the subject.

Lots of people don’t even know you need this, but ignorance of the law is no excuse.

Always protect yourself.

2.       PRIVACY POLICY

This is really important, especially if you have an email list, and you are collecting people’s personal information.

Common sense, right?

Not for most people, unfortunately.

When you gain access to people’s personal information, they have the right to know how you are collecting and using the information.

Here are just a few requirements your Privacy Policy needs:

It needs to be compliant with the CAN-SPAM Act, GDPR, CCPA and other laws; it needs to inform website visitors from the European Union about personal data collected because of the General Data Protection Regulation; and it needs to be implemented because as I mentioned earlier, you are collecting PERSONAL information from people when they sign up for your freebie or for your email list!

3.       DISCLAIMER

The third topic we are discussing is your DISCLAIMER.

Why is this important for your blog or online business?

A Disclaimer does many things, including:

Serves to limit your legal liability for your published content;

it informs the users of your website that the information on your site DOES NOT constitute any kind of advice such as legal, medical, financial, real estate, etc., AND THE LIST GOES ON;

it also discloses any type of affiliate relationships you have with third-party websites you are linking to;

AND it protects you from lawsuits involving product results and earnings.

Basically, YOU NEED a Disclaimer immediately.

These sound like extremely daunting things, and I’m here to tell you, it is really not difficult to start getting yourself covered and on the right track, today.
